Terms of Service

These Terms of Service ("Terms") govern your use of AgentListIQ (the "Service"), provided by AgentListIQ ("we", "us"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

AgentListIQ helps real estate professionals create comparative market analyses ("CMAs") by connecting to MLS data sources that you are authorised to use, scoring comparable sales, calculating adjustments, and producing reports and PDF documents. We also provide a built-in sample market with fictional data so you can try the Service.

2. Your account

The Service is intended for licensed real estate professionals (or people working under a licensed broker), and by registering you confirm that you are one. You are solely responsible for complying with the real estate licensing, disclosure and advertising laws of your state, including any required disclosures on a CMA. You must be at least 18 and able to form a binding contract. You are responsible for keeping your password confidential and for all activity under your account. Provide accurate information and tell us promptly of any unauthorised use. One person per account; do not share logins.

3. Free trial, subscription and billing

• Free trial. New accounts receive a 15-day free trial with full access. No payment card is required to start a trial.
• Subscription. After the trial, continued use of paid features requires a subscription at $19 per month (plus applicable taxes), billed monthly in advance through our payment processor, Stripe. If you subscribe during your trial, your first charge is deferred until the trial ends.
• Renewal and cancellation. Subscriptions renew automatically each month until cancelled. You can cancel at any time from Plan & billing in the app. Cancellation takes effect at the end of the current billing period, and you keep access until then. Existing reports remain viewable after a subscription ends.
• Refunds. Fees are non-refundable except where required by law or where we state otherwise in writing.
• Price changes. We may change the price with at least 30 days' notice before your next renewal. You may cancel before the change takes effect.
• Failed payments. If a payment fails we may retry it and may suspend paid features until the payment is resolved.

4. MLS credentials and data

• When you connect an MLS you represent that you are an authorised participant or subscriber, that your MLS permits you to use these credentials and this data with the Service, and that you will follow all of your MLS's rules, including data-use, display and attribution requirements.
• We act only on your instruction and only to read data for your searches. We do not write to your MLS. We are not affiliated with, endorsed by, or an agent of any MLS or the National Association of REALTORS®.
• We store your credentials encrypted and use them only to retrieve data on your behalf. You can delete a connection at any time, which permanently deletes the stored credentials.
• MLS data remains the property of the MLS and its licensors. You are responsible for any reports, PDFs and share links you create from MLS data, including any required disclaimers (the Service lets you add an MLS attribution line to every report).
• We may suspend a connection if it appears to violate an MLS's rules, creates abnormal load, or is requested to be suspended by the MLS.

5. Reports are opinions, not appraisals

CMAs and valuations produced by the Service are automated estimates that depend on the data you connect and the settings you choose. They are an agent's opinion of value and are not an appraisal, not a guarantee of any sale price, and not legal, tax, lending or investment advice. You are responsible for reviewing and, where appropriate, correcting every report before giving it to a client, and for any statements you make to your clients based on it. Automatic adjustments are general-purpose estimates; always apply your own professional judgment.

6. Acceptable use

You agree not to: (a) use the Service unlawfully or in breach of an MLS's rules; (b) bulk-extract, scrape, resell or redistribute MLS data through the Service; (c) attempt to probe, disrupt or bypass the Service's security or rate limits; (d) upload malicious files; (e) use the Service to build a competing product; (f) misrepresent sample-market data as real; or (g) infringe anyone's rights.

7. Your content

You keep ownership of the content you provide (your profile, logo, photo, notes and reports). You grant us a limited licence to host, process and display that content solely to operate the Service for you, including when you choose to share a report by link. Anyone with a share link can view that report until you turn the link off.

8. Our property

The Service, its software, design and branding belong to us and our licensors. We grant you a limited, revocable, non-transferable right to use the Service for your own business during your trial or subscription.

9. Third-party services

The Service relies on third parties, including Stripe (payments), Cloudflare (human verification), email delivery and hosting providers. Your use of their features may be subject to their terms. We are not responsible for third-party services or for MLS data sources being unavailable or inaccurate.

10. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that MLS data or calculated values will be accurate or complete.

11. Limitation of liability

To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business opportunities, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the three months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

12. Indemnity

You will indemnify and hold us harmless from claims, damages and expenses (including reasonable legal fees) arising from your use of the Service, your reports and the way you use MLS data, or your breach of these Terms or of an MLS's rules.

13. Suspension and termination

You may stop using the Service and delete your account at any time from the app. We may suspend or terminate access if you breach these Terms, if required by an MLS or by law, or if your use poses a risk to the Service or others. On termination your right to use the Service ends; we will delete your data as described in our Privacy Policy.

14. Changes

We may update these Terms. We will post the new version here and, for material changes, notify you by email or in the app. Continued use after the effective date means you accept the update.

15. Governing law

These Terms are governed by the laws of the United States and the state in which AgentListIQ is based, without regard to conflict-of-law rules. Courts located in that state have exclusive jurisdiction, except where the law of your residence requires otherwise.
